Planning conditions not met :
The planning Inspector asked in Feb 2017 for further details on New Lane and Moorside around parking,splays and footways.
Kirklees simply signed off some conditions without further Highways Details being sought or obtained - Knowing they had written up conflicting safety guidelines.
Three Frontage dwellings allowed with drives onto the lane at the Junction Splay  - This was SHLAA recorded Amber access site with no subsequent thought for public or highway safety
The nearby M62 Services and Notorius Chain Bar Junction has daily long queuing / static traffic to 11 miles away Leeds each morning and to Bradford each evening and pollution levels are dangerous to public health - Community and Public Health Sabotage by PINS Volume Targets

What Happens when Council Planning Departments fail to discharge PINS conditions ?

PINS have been notified .. and so have the Council and yet the original unsafe Highways Proposed by the developer remain as was prior to the FEB 2017 conditions requesting 'FURTHER' details to make this a satisfactory development in planning terms.
Temporary car parks without planning permission are placed within 6 feet of existing homes.
Site Plant and HGV traffic is already using an unwidened 4.8 mtr road just a few feet from Frontager homes.





So not content with the PINS
FAILURE TO WEIGH GREENFIELD PROTECTION POLICIES ADEQUATELY by deeming them 'not up to date' we have to put up with Materially Unsafe Junction Access to Green Space development, for Existing and New Residents
Safe Highways would see 5-7 plots removed but nothing has happened so far to meet Inspector Safety Conditions at the site.



Contested Garden strip - possessed decades ago after no public purse expenditure,footway installation or street lighting provision after 1950's street adoption. Alleged Highways adoption extension to take the right hand verge (not shown on LR maps up to 1990). Conveniently no 1980 Highways Act paper work to extend the Highway (verge) exists and LR title is not changed (see section 106 map).

'LET THE BUYER BEWARE'
Could the developer find 30 internal car parking spaces (10 visitor and 18 residents and 2 new dwelling) ? Answer - NO, so safety and Conditions are the makeweight
The Development on Pearson Street and Moorside Displaces existing terraced home residents parking and moves them from a safe 4 home cul de sac (none junction) to an unsafe junction with on street parking obstructing entry and Kirklees provided Moorside Bays for 50 metres (the splay) in both directions left uncleared of obstructions - The developers highways agents argue residents can park dangerously and probably illegally (according to highway code) around the new unsafe junctions instead.
On New Lane the left splay does not take account of 80% of traffic over the centre line travelling within 18 inches of the footway and new junction, in the wrong direction.
  Only Kirklees Highways know the true answers on their INACTION around standards at junctions with A roads. The residents will be reading MFS regulation and will not be deflected onto optional directives - Holding a safety negligent Highways Accountable.

Will the Elevated Arsenic Levels on the site be dealt with ?
Scraped and piled and left ?
Will the two/three times DEFRA allowed levels of Benzo Pyrene allowed on development sites be resolved ?
Will customers know they are potentially buying houses on Land that DEFRA states vegetables cannot be grown on due to risks to health ?
Will Customers be aware that they are literally undermined with shallow mines across the site ?
Will customers be aware to avoid recurring Woodland management / site fees that absolve the developers from maintenance liability - who cuts the large trees ?
Will customers be aware to beware of Leasehold purchases and subsequent Freehold purchase traps ?
Will customers know why they dont have permitted development rights on some plots ?
Should residents now look to purchase Green Space and Speculative Fields near Spawforths and Strata Homes Directors local areas to test nimbyism ?
Lets play the same games / use loop holes in the process to get housing in their backyard.




The Story >
The Battle for Spen is about national corruption around the NPPF and the planning process and broken pledges in Govt Manifestos (2010 and 2015 promises) to get net migration into the tens of thousands and contrary pledges to protect Greenbelt that local plans now seek to place 500,000 homes on (CPRE / Local Plans watch). This is an issue of Public Consultation, Consent and Trust and Govt. Integrity. NHS transformation (cuts) , Health and Social Care collapse, House ownership and affordability collapse in Britain, School under funding and over crowding, Prisons Collapse, Sports Centre Closures are all linked to hidden per head reductions of services funding - Its all linked to claimed GDP growth, tax take erosion and Manifesto pledge failures that has been brought at the expense of everyone in the hidden GDP - Beds per head or school pupil per head metrics. More people have migrated to England in the last seven years (ons / migration watch) than new houses have been built for, so we have not even stood still with housing stocks per head.
A GOVT FAILING TO PLAN with CONSENT AND SO PLANNING TO FAIL ITS PEOPLE
WHAT IS A LIE IN A MANIFESTO PLEDGE ?  something you state to the public to win votes without any intention of being able to or wanting to carry it out ?
POLITICIANS SO MISTRUSTED (they no longer seem to care as a collective about lying in public or on tv or in parliament and seem to think that they can spin the truth of reduced funding per head as increased funding) SO MUCH SO THAT MANIFESTOS NOW NEED TO BECOME THE FIRST (BILL) LAW A NEW GOVT PASSES
Presumption in favour of Unsustainable development is a national disgrace.
Where housing is fitted into existing or reducing community infrastructure whilst at the same time a claim about a growing economy is made.
A growing economy needing to cut everything ?  So none of this is sustainable development.
Any Honesty or Integrity would see the GOVT. announce where IT is going to put nine (English Regions) new cities on the Greenbelt to fix the problem they (not the people) or councils have created.
Fully funded new Cities of between 100,000 to 250,000 affordable homes that have the schools and hospitals they need so as to not damage existing communities and further degrade quality of life,congestion, air quality and services.

Our local evidence - £96,000 sent out of area to the nearest school with places - 2.1 km away and 25 minutes walk whilst this areas deprived schools are full (Hightown and High Bank) and get nothing. The Sports Centre is now closed. We have no college or sixth form facilities. Dewsbury Hospital (our local hospital) has its maternity unit scaled down and childrens ward closed in an area where the birth rate is 4.2 (in the highest 10% in the country) , its A&E under threat and Huddersfield our Civic centres hospital, set to lose its A&E totally in favour of pfi Halifax and Calderdale. With Spen locals expected to travel on the M62 log jam as we try to get to pfi Pinderfields in Wakefield. So a failed plan for 450,000 Kirklees residents and much the same next door in Bradford - Englands 5th biggest City. Together 1 million people let down with a totally Unsustainable plan that tries to rely on house building anywhere and commutes out to Leeds or Manchester for jobs that the govt intends to fund bias (super councils and city regions) to make them suck in the limited regional money. The London model of congestion, air pollution and two hour daily commutes, tagged onto the working day, attempted to be inflicted on the North in Yorkshire and Lancashire.
